DMCA Policy

Moose Tracks Overnight Oats Introducing ("we," "us," or "our") respects the intellectual property rights of others and is committed to complying with U.S. copyright law, including the Digital Millennium Copyright Act ("DMCA"). This policy outlines the procedures for copyright holders to notify us of alleged infringement and for users to submit counter-notifications when their content has been mistakenly removed.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. We will take appropriate actions, which may include removing or disabling access to the infringing material.

Filing a DMCA Notice of Alleged Infringement

If you believe that your copyrighted work has been copied and is accessible on our platform in a way that constitutes copyright infringement, you may submit a written DMCA notice to our designated Copyright Agent. For your notice to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the specific URL(s) of the infringing content).
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Upon receipt of a valid DMCA notice, we will investigate the claim and take appropriate action, which may include removing or disabling access to the alleged infringing material.

Filing a DMCA Counter-Notification

If you believe that material you posted on our platform was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. For your counter-notification to be valid under the DMCA, you must provide the following information:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific URL(s)).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Moose Tracks Overnight Oats Introducing may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward a copy of it to the original complaining party. Unless the copyright owner files an action seeking a court order against you within 10 to 14 business days of receiving the counter-notification, we may, at our discretion, restore the removed material or cease disabling access to it.
